Experimental Features Terms

Version 2026-10-25 · Last updated: 25 October 2026

Experimental features are pre-release and provided for evaluation only

They may be incomplete, inaccurate, or withdrawn without notice, and they carry no service commitment. Every output must be reviewed by a qualified clinician before it is relied on or filed.

1. About These Terms

These Experimental Features Terms (“Experimental Terms”) govern access to and use of the experimental features of the MEDsort platform provided by MEDsort Pty Ltd (ABN 84 102 943 944) (“MEDsort”, “we”, “us”, or “our”).

The Experimental Terms supplement our Terms of Service, Privacy Policy and Data Storage Policy, which continue to apply. To the extent of any inconsistency, the Experimental Terms prevail in relation to experimental features.

By using an Experimental Feature you agree to the Experimental Terms. You agree to them personally and confirm that your practice (the “Practice”) has authorised you to use Experimental Features. Where you are a practice administrator, you also agree to them on behalf of the Practice and represent that you have authority to bind it. In these terms, “you” means you and the Practice.

2. What Experimental Features Are

Experimental features are pre-release capabilities of the Service that we make available to practices for evaluation before they are generally released (“Experimental Features”). At the date of this version they include:

  • Patients — a patient list and record view
  • Tasks — a practice task workspace
  • MEDscribe (with Dictate) — consultation recording, transcription and draft clinical notes, letters, referrals and tasks, and the filling of government, insurer and the Practice's own forms from a consultation
  • My Templates — a document template workspace
  • New forms — the Practice's own blank PDF forms, marked up so that MEDscribe can fill them

We may add features to, or remove features from, the Experimental Features at any time. The pages marked “Beta” in the app at the time of use are the authoritative list.

3. Agreeing to the Experimental Terms

Experimental Features are available to every user of the Practice. Every Experimental Feature in the app shows a “Beta” notice linking to these terms. Each user who uses an Experimental Feature agrees to the version of the Experimental Terms current at the time of use. If you do not agree to them, do not use Experimental Features.

No approval by MEDsort is required. We may nonetheless pause, limit or withdraw the Practice's access to any or all Experimental Features at any time, with or without giving a reason (see section 15). Access does not create any obligation to continue to provide any Experimental Feature or to release it generally.

The Practice is responsible for ensuring that every user of the Practice who uses an Experimental Feature is aware of, and complies with, the Experimental Terms.

4. Nature of Experimental Features

You acknowledge that Experimental Features:

  • are under active development and may be incomplete, unstable, inaccurate, or behave unexpectedly;
  • may rely on artificial intelligence models, speech recognition and third-party services that are themselves in preview, and may produce outputs that are wrong, incomplete, fabricated or out of context;
  • may be changed, paused, restricted, or withdrawn at any time without notice, and any work in progress within a feature may be lost when this happens;
  • may not be connected to your practice management system, or may be connected to a limited or simulated data source, until the relevant integration is released; and
  • are excluded from any availability, support, response-time or other service commitment that applies to the rest of the Service, and are not covered by any written service agreement unless it expressly says so.

Experimental Features are not intended for use as the Practice's primary or sole system for any clinical or administrative process.

5. Clinical and Professional Responsibility

Experimental Features are workflow and documentation aids. They are not a medical device, diagnostic system, clinical decision-support system, or substitute for professional judgement, and nothing they produce is medical advice.

Every transcript, draft note, letter, referral, task, template, extracted field or other output of an Experimental Feature is a draft. It must be reviewed, corrected and approved by a qualified, authorised clinician or staff member before it is relied on, sent, filed, or entered into any patient record or third-party system. Transcripts in particular may misattribute speakers, omit words, or misrecognise medication names, doses and clinical terms.

The Practice remains solely responsible for the accuracy, completeness and lawfulness of its clinical records and communications, for every clinical and professional decision made in connection with an Experimental Feature, and for compliance with the professional, record-keeping and regulatory obligations that apply to it and its practitioners.

6. Recording Consultations

Some Experimental Features, including MEDscribe and Dictate, record and transcribe audio. Before recording any consultation or conversation, the Practice must:

  • tell the patient, before recording, that an AI scribe will be used to transcribe the consultation and draft notes from it, consistent with Ahpra and RACGP guidance on the use of AI scribes;
  • obtain and document the informed consent of the patient and every other person whose voice may be recorded, and stop recording if consent is withdrawn;
  • comply with all surveillance devices, listening devices, privacy and health records laws that apply in the state or territory where the recording takes place; and
  • ensure that the recording device, microphone and browser are set up so that only the intended consultation is captured.

MEDsort does not obtain consent on your behalf and does not verify that consent has been given. The Practice is solely responsible for any recording made using the Service.

7. Your Obligations

In using Experimental Features, you must:

  • use them only for the lawful internal purposes of the Practice and only through authorised users;
  • keep your practice management system as the system of record for every patient and clinical matter, and copy into it anything you need to keep. A stored MEDscribe session (section 8) is a convenience copy for the recording clinician, not a clinical record;
  • not use them to process information you are not authorised to process, or in any way that breaches a patient's privacy or a professional obligation;
  • not attempt to reverse engineer, probe, interfere with, or circumvent the security or access controls of any Experimental Feature; and
  • tell us promptly at support@medsort.com.au about any error, security concern, or unexpected behaviour you observe.

8. Data Handling

Default: nothing stored. Patients, Tasks, My Templates, New forms and document processing follow the same principle as the rest of the Service: patient details, extracted fields and form answers are processed transiently, shown to you in your session, and are not retained by MEDsort once the session or request ends. Audio is never stored. The contents of a file attached to a MEDscribe session are never stored. Only operational metadata, such as which feature was used, by which role, when, and whether it succeeded, is recorded.

Exception: MEDscribe sessions are stored. MEDscribe saves each session automatically while the clinician works, until they delete it. What is stored: the transcript and its corrections, draft notes and their versions, letters, referrals and other documents (including the address a document was sent to and the patient chart a document was filed to), tasks and actions, typed context, the patient label and patient identifier, and the names, types and sizes of attached files. It is stored encrypted (AES-256-GCM under a per-practice key wrapped by Google Cloud KMS) in the Practice's own MEDsort database in Australia. Within the app, only the clinician who recorded the session can open it; practice administrators and other users cannot, and MEDsort does not access sessions except to operate the Service or as required by law. No automatic expiry or deletion is currently implemented: a session stays until the clinician deletes it, and a pause or withdrawal by MEDsort does not delete it.

Corrected words. When a clinician corrects a word by hand in a MEDscribe transcript, a MEDscribe note or a Dictate transcript, MEDsort may keep the words before and after the correction (for example, “Panamax” corrected to “Panadol”), whether the correction was made in a transcript, a note or a dictation, and the month it was made. Before anything is kept, the sentence around the correction is checked by Google Cloud Sensitive Data Protection in Australia, and a correction that looks like a name, date, number or other identifier is discarded. The sentence itself is never kept, and what is kept is not linked to a practice, a clinician, a session or a patient. MEDsort reviews these words to assess and improve transcription accuracy, and deletes any that identify a person.

Processing location. Transcription and the editing of an existing note take place in Australia (australia-southeast1). Generating draft notes, letters and referrals from a transcript or typed text uses Anthropic's Claude API with global routing, so that content may be processed on Anthropic infrastructure outside Australia for the duration of the request; under Anthropic's commercial terms it is not used to train Anthropic's models. If Claude does not answer in time, the note is written in Australia instead. Draft notes from a recording, form answers, New forms field detection (on the blank form) and document extraction use Google Vertex AI's global endpoint, so that content may be processed on Google infrastructure outside Australia for the duration of the request. Under Google's Vertex AI terms the content is not used to train Google's models. The Practice remains responsible for its own privacy notices and consents, including any required under Australian Privacy Principle 8 (APP 8), and should not use MEDscribe if cross-border processing is not acceptable to it.

The Privacy Policy explains how we handle personal information generally, and the Data Storage Policy describes our infrastructure.

9. Feedback and Usage Information

We welcome feedback on Experimental Features. Any suggestion, comment, report or other feedback you give us may be used by MEDsort for any purpose, including to improve the Service, without restriction, attribution or payment. Feedback must not include patient information.

We collect usage information about Experimental Features (for example, which features are used, how often, by which role, and whether an action succeeded) so that we can assess them. This information is operational metadata only and never includes patient or clinical content. Corrected words are described in section 8.

10. Confidentiality

Non-public information that MEDsort shares with the Practice about Experimental Features, such as roadmaps, unreleased designs and pre-release builds, is confidential information of MEDsort and may be used only to evaluate the features and discussed only within the Practice and with us. Nothing in this section stops you from using Experimental Features in the ordinary course of your practice, demonstrating them to colleagues, or describing your experience of them.

11. Fees

Experimental Features are currently provided at no additional charge. We may make any Experimental Feature, or its generally released successor, subject to a fee on reasonable notice, and you will not be charged unless you agree to that fee. No credit, refund or set-off is available for the unavailability, change, or withdrawal of an Experimental Feature.

12. Disclaimers

To the maximum extent permitted by law, Experimental Features are provided on an “as is” and “as available” basis, for evaluation purposes only. MEDsort disclaims all warranties, representations, guarantees, and conditions in relation to Experimental Features, whether express, implied, statutory, or otherwise, including any warranty of accuracy, fitness for a particular purpose, non-infringement, availability, or that they will be released, continued, or free from errors or interruptions.

Nothing in the Experimental Terms excludes, restricts, or modifies any consumer guarantee, warranty, right, remedy, or liability that cannot lawfully be excluded, restricted, or modified under applicable Australian law.

13. Limitation of Liability

To the maximum extent permitted by law, MEDsort will not be liable for any loss or damage of any kind arising from or relating to an Experimental Feature, including any indirect, consequential, special, incidental, exemplary or punitive loss, loss of profit, revenue, goodwill or data, loss of work in progress, clinical, regulatory or professional consequences, business interruption, or loss arising from reliance on an output that was not reviewed as required by section 5.

To the maximum extent permitted by law, and notwithstanding any cap in the Terms of Service, MEDsort's aggregate liability for all claims arising from or relating to Experimental Features is limited to AUD $100.

These limitations do not apply to the extent liability cannot be excluded or limited under applicable law.

14. Indemnity

You indemnify MEDsort, its officers, employees, contractors, and suppliers from and against all claims, losses, damages, liabilities, costs, and expenses arising from or relating to the Practice's use of Experimental Features, including any recording made without the consent required by section 6, any output relied on, sent or filed without the review required by section 5, any breach of the Experimental Terms, and any clinical, professional, regulatory or business decision made using or relying on an Experimental Feature.

15. Suspension, Withdrawal, and Turning Off

We may suspend, restrict or withdraw an Experimental Feature, or the Practice's access to Experimental Features, at any time and without notice, including where we consider it necessary for security, privacy, clinical safety, legal or regulatory reasons, because of a breach of the Experimental Terms, or as part of ordinary product development.

Any user may stop using Experimental Features at any time, and the Practice may ask us to withdraw its access at support@medsort.com.au. Neither affects the rest of the Service, and stored MEDscribe sessions remain as described in section 8. Sections 5, 6, 9, 10, 12, 13, 14 and 17 survive any withdrawal, suspension or switch-off.

16. Changes to These Terms

We may update the Experimental Terms from time to time. Each version carries a version number shown at the top of this page. When the version changes, the new version applies from the date shown at the top of this page, and using Experimental Features after that date means you agree to it. Stored MEDscribe sessions are unaffected by a version change.

17. Governing Law

The Experimental Terms are governed by the laws of Australia, and the courts of Victoria, Australia have non-exclusive jurisdiction over any dispute arising from them. You agree to comply with all laws and professional obligations that apply to your use of Experimental Features.
